At what point can I back out?

Adoptive parent sometimes do choose not to adopt an infant (not usually after placement in their homes) if the child is born with severe special needs or drug exposed.

You are under no legal obligation until the baby is born and you finalize the papers to become the legal guardian. In California, finalization occurs 30 days after you sign the papers.

When birthparents rights are terminated, legal custody is given to the agency or lawyer involved in the case. Guardianship is awarded to the adoptive parents after finalization. In most cases, if the adoptive parents back out of an adoption, the agency or attorney will find a family to adopt from within their “available families”.
